New federal EVV regulations for Nebraska Medicaid were to be fully implemented by August 2024 but have yet to be completed by the approved deadline. Planned Changes to EVV Federal Requirements

The new EVV implementation to Nebraska’s DHHS is one of multiple enhancements required by the 21st Century Cures Act (Cures Act). The law, signed under President Obama in 2016, was created to improve the health of all Americans by increasing access to care, simplifying regulations, improving mental health services, and much more. Personal assistance services and home health services will be utilizing the new EVV requirements, which include:

  • GPS or IVR (Interactive Voice Response) to capture visit start and end times
  • Critical errors for manual updates, unapproved visit verification methods, or unverified IVR phone numbers
  • New Geofence requirement based on Nebraska zip codes
  • Recipient’s signature for all GPS visits in the EVV mobile app
  • Verification of proper authorization of services

EVV Implementation Pause for Nebraska DHHS

The Nebraska Auditor of Public Accounts (APA) and Nebraska DHHS have discovered many of the required EVV changes have yet to be implemented entirely. The new implementation date of January 8, 2025, allows more time to execute a complete and accurate transition to the EVV federal requirements. Not only will the pause enable compliance with all EVV regulations, but it will also allow Nebraska Medicare to claim federal funding for services that require EVV.
